This Privacy Policy ("Policy") describes how PreScreen Environmental, LLC, a Florida limited liability company ("Company," "we," "us," or "our"), operating under the trade name PreScreenESA, collects, uses, discloses, and protects your personal information when you use our website at www.prescreenesa.com and our environmental risk screening platform (collectively, the "Service"). By using the Service, you consent to the practices described in this Policy.

1. Information We Collect

1.1 Information You Provide

We collect information you voluntarily provide when you create an account, make a purchase, or contact us:

  • Account information: name, email address, and password
  • Payment information: processed by Stripe, Inc. We do not store credit card numbers, CVV codes, or full card details on our servers. Stripe handles all payment data in accordance with PCI DSS standards.
  • Profile information: any additional information you choose to add to your account
  • Communications: messages you send to us via email or through the Service

1.2 Information Collected Automatically

When you use the Service, we automatically collect certain information:

  • Usage data: pages viewed, features used, property searches performed, reports generated, and properties saved
  • Device information: browser type, operating system, device type, and screen resolution
  • Log data: IP address, access times, referring URL, and pages visited
  • Cookies and similar technologies: session cookies for authentication, preference cookies for user settings. We do not use third-party advertising cookies.
  • Location data: general geographic location derived from your IP address. We do not collect precise GPS location.

1.3 Property Search Data

When you use the Service to screen properties, we collect and store property addresses and parcel IDs searched, geographic coordinates of searched locations, environmental screening results and risk assessments, generated reports and their contents, and properties you save to your account. This data is necessary to provide the Service and is associated with your user account.

2. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve the Service
  • Process your transactions and send related information, including purchase confirmations and report delivery notifications
  • Create and manage your user account
  • Generate environmental risk screening reports at your request
  • Send you technical notices, security alerts, and support messages
  • Send you product updates and new feature announcements (you may opt out at any time)
  • Respond to your comments, questions, and customer service requests
  • Monitor and analyze usage trends to improve the Service
  • Detect, prevent, and address technical issues, fraud, or security concerns
  • Comply with legal obligations

3. Information We Do NOT Collect or Sell

We do not sell, rent, or trade your personal information to third parties for marketing purposes. We do not:

  • Sell your personal data to data brokers, advertisers, or any third party
  • Share your property search history with third parties for their marketing purposes
  • Use your data to build advertising profiles
  • Store credit card numbers or payment card details on our servers
  • Collect Social Security numbers, driver's license numbers, or government-issued identification
  • Knowingly collect information from children under 13 years of age

4. How We Share Your Information

4.1 Service Providers

We share information with third-party service providers who perform services on our behalf, including Stripe (payment processing), Supabase (database hosting and authentication), Vercel (website hosting), Resend (transactional email delivery), Mapbox (map rendering and geocoding), Cloudflare (content delivery and security), and xAI or Anthropic (AI-powered risk analysis generation). These providers are contractually obligated to use your information only as necessary to perform their services.

4.2 Government Data Sources

To provide environmental screening results, the Service queries publicly available government databases operated by the Florida Department of Environmental Protection (FL DEP), the U.S. Environmental Protection Agency (EPA), and the Federal Emergency Management Agency (FEMA). These queries transmit geographic coordinates (latitude and longitude) of the properties you search. No personal identifying information is transmitted to these agencies through our queries.

4.3 Legal Requirements

We may disclose your information if required to do so by law, regulation, legal process, or governmental request, or if we believe disclosure is necessary to protect the rights, property, or safety of PreScreen Environmental, LLC, our users, or the public.

4.4 Business Transfers

If PreScreen Environmental, LLC is involved in a merger, acquisition, asset sale, or bankruptcy, your personal information may be transferred as part of that transaction. We will notify you via email and/or a prominent notice on our website of any change in ownership or use of your personal information.

5. Data Retention

  • Account information: retained for the life of your account; deleted upon account deletion request
  • Generated reports: retained indefinitely and accessible through your account dashboard as long as your account is active
  • Saved properties: retained until you remove them or delete your account
  • Payment records: retained for 7 years for tax and legal compliance purposes
  • Email communication logs: retained for 2 years
  • Usage and log data: retained for 1 year, then anonymized or deleted

After account deletion, we may retain certain information in anonymized or aggregated form for analytical purposes. We will also retain information as necessary to comply with legal obligations, resolve disputes, and enforce our agreements.

6. Data Security

We implement reasonable technical and organizational measures to protect your personal information, including encryption of data in transit using TLS/SSL, bcrypt hashing of passwords (we cannot see or recover your password), payment processing handled entirely by Stripe (PCI DSS Level 1 certified), access controls limiting employee access to personal data on a need-to-know basis, and regular security monitoring and updates.

While we take reasonable precautions to protect your information, no method of transmission over the Internet or method of electronic storage is 100% secure. We cannot guarantee the absolute security of your information.

7. Your Rights and Choices

7.1 Account Information

You may update, correct, or delete your account information at any time by logging into your account and visiting the Account Settings page. You may also contact us at info@prescreenesa.com to request changes.

7.2 Account Deletion

You may request deletion of your account and associated personal data by contacting us at info@prescreenesa.com or by using the account deletion feature in your Account Settings. Upon receiving a verified deletion request, we will delete your personal information within 30 days, except for information we are required to retain for legal, tax, or compliance purposes.

7.3 Email Communications

You may opt out of promotional emails by clicking the "unsubscribe" link in any promotional email or by adjusting your notification preferences in Account Settings. You cannot opt out of transactional emails related to your account, purchases, or generated reports, as these are necessary for the operation of the Service.

7.4 Cookies

Most web browsers are set to accept cookies by default. You may set your browser to refuse cookies or alert you when cookies are being sent. If you disable cookies, some portions of the Service may not function properly, including authentication.

8. State-Specific Rights

8.1 Florida Information Protection Act (FIPA)

If you are a Florida resident, you have the right to be notified in the event of a data breach affecting your personal information. We will provide such notification in accordance with Section 501.171, Florida Statutes.

8.2 California Residents (CCPA/CPRA)

If you are a California resident, you have additional rights under the California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), including the right to know what personal information we collect, the right to delete your personal information, and the right to opt out of the sale of personal information. 8.3 Other State Privacy Laws

9. Third-Party Links

The Service may contain links to third-party websites, including environmental consulting firms listed in our Find A Consultant directory and government agency websites. We are not responsible for the privacy practices or content of these third-party sites. We encourage you to review the privacy policies of any third-party website you visit.

10. AI-Generated Content and Data Processing

When you request an environmental risk screening, we transmit the following information to our AI service provider (xAI or Anthropic) to generate the risk analysis narrative: the geographic coordinates of the screened property, environmental data factors returned by government database queries (site names, distances, regulatory status), and property address and parcel identification number.

We do not transmit your name, email address, payment information, or other personally identifying information to the AI service provider. The AI provider processes this data solely to generate the risk analysis and does not retain it for training purposes under our agreement.

11. International Users

The Service is operated in the United States and is intended for use within the United States, specifically the State of Florida. If you access the Service from outside the United States, please be aware that your information may be transferred to, stored, and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using the Service, you consent to such transfer, storage, and processing.

12. Children's Privacy

The Service is not directed to individuals under the age of 13. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information promptly. 13. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by posting the updated Policy on our website and, if you have an account, by sending an email notification. The "Effective Date" at the top of this Policy indicates when it was last revised. Your continued use of the Service after any changes constitutes acceptance of the updated Policy.
